District Council 37 members ratify contract by overwhelming
margin of 89%
Members of District Council 37, the
city's largest public employees' union, have voted overwhelmingly by a margin
of 89% to ratify the wage pact recently negotiated between the union and
the City of New York, DC 37 Executive Director Lillian Roberts announced
today. The contract covers the period from July 1, 2002, through June 30,
2005.
"The ratification of this contract gives members money
in their pocket, a fair wage increase and an agreement we can build on
in future negotiations," said Ms. Roberts. "We fought hard for
this contract agreement and for the ratification of the contract. I'm
pleased that so many members validated the hard work of the Negotiating
Committee. I want to thank all the members who supported the contract
and voted by mailing in their ballots."
The votes cast totaled 54,451 with 53,583 declared eligible ballots. A
total of 94,344 ballots were mailed out and 57.7% were returned. The outcome
was 47,752 for and 5,753 against, a margin of 89% percent in favor of
ratification.
The tentative contract agreement was reached on April 20.
The ratification vote was conducted in accordance with the DC 37 Constitution,
which mandates that all union-wide contract votes be conducted by an independent
third party. The American Arbitration Association (AAA) mailed ballots
out to the members on May 10, 2004. Ballots had to be received at the
AAA by 9:00 a.m. Tuesday, June 1.
Under terms of the new contract, the 94,300 members covered
by the agreement will receive a $1,000 lump sum payment upon ratification.
Part-time employees will receive a pro-rated share of the $1,000. There
will be a 3 percent wage increase retroactive to July 1, 2003. Members
will also receive a 2 percent compounded pay increase effective July 1
of this year. An additional 1 percent increase in the third year will
be available subject to identification of funding through a Joint Labor
Management Committee on Productivity Initiatives.

1. Term of Contract

2. Wage Increases
$1,000 (pensionable, consistent with applicable law) lump sum cash
payment payable upon ratification (pro-rated for other than full-time
employees).
3% 1st day of 13th month (7/1/03)
2% 1st day of 25th month (7/1/04), compounded.
3. An additional 1% will be available, subject
to identification of funding, through the Joint Labor Management
Committee on Productivity Initiatives. Resources generated can be
used to provide an additional salary increase in the third year
and/or allow for improvement of Citywide benefit modifications for
new employees.
4. Joint Committee on Productivity Initiatives
Co-chaired by the Deputy Mayor for Operations and the DC 37 Executive
Director. The Committee will identify efficiencies including but
not limited to examining sick leave usage, streamlining Workers
Compensation and contracting in. The Committee will report in October
2004 on these additional productivity savings to be applied to DC
37.
5. Citywide Benefit Modifications
a. All employees shall be eligible to use three (3) days of sick
leave to care for an ill family member.
6. Labor Management Committees
Labor Management committees will be established to:
Explore resources for child care
Review pension issues including Physically Taxing titles
Explore telecommuting and alternate work schedules
7. Continuation of all other terms of the previous
economic agreement.
* Effective dates are different
for Family Paraprofessionals and Marine Titles.

Benefit modifications
for new hires, appointed
on or after July 1, 2004
5b. The hiring rate for employees
hired on or after July 1, 2004 will be 15% lower than the incumbent
rate. After two years of service, employees will earn the incumbent
rate.
c. Employees hired on or after July 1, 2004 will earn a new annual
leave schedule:

d.
Night shift differential will be in effect from 8:00 p.m. to 8:00
a.m. for employees hired on or after July 1, 2004, for the first three
years of employment.
e. Employees hired on or after July 1, 2004, will cash out their
sick leave on the basis of one day of terminal leave for each three
days of accumulated sick leave upon separation from city employment
after 10 years of service.
f. Employees hired on or after July 1, 2004, will accrue sick leave
at a rate of 10 days per year for the first five years of employment.
g. Employees hired on or after July 1, 2004, will not be eligible
for the floating holiday. |
2002-2005 DC 37 Economic Contract Ratification Process
1. The American Arbitration Association will be mailing
out ballot packages to eligible union members on May 10, 2004.
2. The ballots must be received by the AAA no later
than 9 A.M. on Tuesday, June 1, 2004.
3. If a person who believes he or she is entitled
to vote has not received a ballot by May 14, the person should call the
AAA at 1-800-529-5218 to request a ballot.
4. The vote count will be conducted at AAA offices
on June 1, 2004, after 9 A.M.
5. The following employees are NOT eligible to vote
and will NOT be receiving ballots:
a. All agency fee payers
b. Employees in prevailing rate titles
c. Employees who work at

5. SCA
6. NY Law School
